Paid and Unpaid Defaults

Removal of defaults from a credit file/report may be possible where the creditor has failed to comply with the legislative requirements and mistakenly reported a default against an individual.

First, it must be established that an error has been made by a creditor before we are able to assist in clearing any default from your file. That’s why we provide AN OBLIGATION FREE CONSULTATION prior to accepting any fees, or taking a file on.

All Australian Court Judgements And Writs

Each jurisdiction is different and it can be difficult to know what to do or how to do it. That’s why our expert lawyers can assist you in dealing with these matters in an easy and uncomplicated way.

Credit Enquiries

Enquiries indicate to other creditors what loans/credit you may have applied for, which in turn can negatively impact upon your score or rating. If you have too many enquiries within a short space of time, this can negatively affect your score and ability to obtain finance. We can assist you in having the enquiries removed from your credit report, therefore improving your score and likelihood of obtaining finance.

Commercial Defaults

Unfortunately, when it comes to commercial defaults, creditors do not have the same stringent legislative requirements to fulfill before listing an infringement against you or your commercial entity.

This is a complex area of law and requires the attention of qualified lawyers to achieve success.

Debt Negotiations

We aim to make the process as easy and comfortable as possible as we assist you with your debt negotiation matters and hardship applications.

Late Repayment History

Credit providers are able to record late or missed payments on your credit file as part repayment history information, this can affect your ability to borrow as you may deemed as a ‘credit risk’. We can analyse your situation to determine if there are reasonable grounds for the clearing of the adverse repayment history. Contact us Today!

There are a few options in ordering your credit report and the path you take will depend on the urgency of your situation.

60% of all adverse entries have been listed in error. Our Team will need to analyse your personal circumstances to determine what exactly has occurred and to advise if we can assist you

NO! Creditors often imply or use misleading language. In many instances, creditors may advise that they will “update” or “improve” your credit file once you have paid. However, this does not remove the default. By allowing us to represent you, we ensure that the creditor does not use misleading language – we can ensure that once we have received consent for the removal of the default, that it will be removed from your file promptly.

 Defaults can be listed following overdue accounts, bills or credit contracts, including but not limited to;

  •         Telecommunication Contracts such as Phone plans
  •         Utility Services
  •         Credit Cards/Personal loans
  •         Home Loans
  •         Equipment Finance

You will most likely be paying interest at a much higher rate. Over time, the higher interest you would pay far outweighs the amount it would cost you to clear your Credit file. Also, by clearing the defaults it will increase your likelihood to obtain finance at a more competitive interest rate.

A credit score can be affected in many different ways. You may have had too many enquiries in a short period of time. It could also be that you missed some payments on one of your credit accounts. We analyse your credit report for free to advise of the reason it is low.

By a default dropping off, it does not necessarily mean that the debt is no longer owing or does not exist. Creditors can still chase you for outstanding debts and obtain judgements against you to retrieve their outstanding money. We can represent you in negotiations with Creditors regarding a debt on your behalf, so that in the future it does not return to negatively impact you.

A credit report is a collection of your data that informs creditors about you, your reliability and your credit history. Each report has your personal details, employment history, a list of lenders you’ve applied to, any late payments, defaults or judgments, clear-outs, crossed or linked files, bankruptcies and current or previous directorships – all this information is collated in one area and gives a score. Your credit score is used by creditors to assess your credit worthiness. Unsure what is on your credit file? We can order you a free credit report

Your credit score is made up of previous applications you have made for financial products such as a credit card, home loan, car finance and/or personal loan. Your credit file is reviewed by lenders to determine if you can borrow the amount being requested. If there are any adverse entries on the credit file, it can influence a lender to either decline your application or add a premium to the interest rate to compensate for the perceived added risk.
